Construction Disputes & Litigation

Construction Litigation

Dolley Law, LLC litigates construction cases in state and federal court, as well as in alternative dispute forums, such as arbitration and mediation. Because of the nature of the construction industry, clients often require prompt and immediate action be taken to protect their legal rights. Our extensive litigation knowledge and experience allows us to effectively address these disputes as they arise, whether it is on an expedited basis or not.

Legal Guidance in Construction Law Litigation

We regularly provide legal guidance and plans of action necessary to successfully resolve disputes. Construction projects and contracts can be complex and potential problems may develop before, during or after the construction is completed. Each case requires specific analysis and determination of the appropriate course. We tailor plans of action to maximize recovery or minimize legal liabilities while maintaining an eye on fees and costs associated with the litigation process.

If your company has been served with notice of litigation, including service of a summons or a formal demand letter, we can immediately help to address such pressing legal matters as appropriate. When litigation is or becomes necessary, we work zealously to ensure the best outcome for our clients through aggressive representation at all stages of the litigation process, from initiation of the case, through the discovery and depositions phase, up through to trial and any appeals, if necessary.

Many construction-related disputes or cases are resolved through alternative dispute resolution, such as arbitration and mediation. Construction arbitrations are commonly held under the construction arbitration rules set out by the American Arbitration Association (AAA). Construction arbitrations are often held before single arbitrator or three arbitrator panels. The terms and agreements set out in the underlying construction contract most commonly determine the form of arbitration.
