Why Medical Transcriptionists Are Entitled to Overtime Compensation

The Department of Labor has specifically stated that transcriptionists working for per line wages are entitled to overtime compensation as non-exempt employees.

Medical transcriptionists commonly review recordings on a headset and key in text to a computer, editing grammar and for clarity. The documents produced are a variety of medical documents for review and signature by physicians and other medical professions. Medical transcriptionists are required to accurately transcribe information, understand medical terminology and abbreviations and complete medical records.

Transcription may be received in digital format and returned by electronic means. There is increasing software used to aid in voice communication and speech recognition. Many medical transcriptionists work in hospitals and doctors' offices and commonly have other duties and responsibilities such as scheduling, answering phone calls, mail and secretarial duties.

Medical transcriptionists are entitled to overtime because they meet do not qualify for the executive exemption as they do not supervise two or more full time employees. 29 C.F.R. § 541.100(a)(3). In completing dictation, medical transcriptionists do not qualify for the administrative exemption because their primary duties do not involve the exercise of discretion and independent judgment. 29 C.F.R. § 541.200(a)(3). Medical transcriptionists final do not appear exercise qualifying discretion and independent judgment and instead perform manual transcription work. 29 C.F.R. § 541.202(b).
