St. Louis Missouri Workers Comp Process

Missouri Workers' Compensation law provides disability payments, lost wages and medical benefits to injured employees. These benefits are available when a St. Louis worker is injured as a result of an accident, injury or occupational disease on-the-job.

In Missouri, employers with five or more employees and any employer in the construction industry with one or more employees is required to maintain workers' compensation insurance coverage for its employees. Your employer has a duty to post notices of rights under Missouri worker's compensation law. When an employer is notified of an injury on the job they are required to provide medical care and required benefits under Missouri law.

Filing Missouri Workers Compensation Claims on Behalf of St. Louis Workers

A St. Louis employee who sustains a work-related injury may file a claim for benefits. The employee may have a traumatic physical injury, repetitive trauma injury, mental injury or occupational disease. Injured employees that successfully prosecute the case to the Missouri Division of Worker's Compensation receive money and medical benefits on a weekly or bi-weekly basis.

Steps to Protecting Your Missouri Workers Compensation Claim

It is better if you try to communicate with your employer about the facts of the accident, the medical circumstances, and other problems you are experiencing as a result of any injury or disability. An employer who retaliates for filing a workers' compensation claim may be subject to further legal action for wrongful termination or retaliatory discharge.

Covered Injuries Under Missouri Workers Comp Law

1. Traumatic Physical Injuries – These injuries occur during a specific time or specific work shift injury or accident as opposed to an injury that occurs over a period of time.

2. Repeated Trauma Injuries - These injuries are typically caused by repetitive movements and occur over a period of time rather than one specific injury or accident.

3. Mental Injuries - These injuries manifest themselves psychologically and may occur whether or not you have suffered a physical injury.

4. Occupational Diseases – These diseases are medical conditions which develop over time due to the environment at work and other work-related conditions.
