Company Defense of Sexual Harassment Claims

The Law Offices of Kevin J. Dolley provides legal counsel and defense to employers against claims of sexual harassment.  Because of the need for management to investigate and take remedial action in response to claims of sexual harassment, Attorney Kevin J. Dolley provides timely legal counsel to management in addressing claims of sexual harassment and averting costly charges of discrimination and sexual harassment litigation.

Legal Counsel for Employers Accused of Sexual Harassment

Because of the continuing changes in sexual harassment law, the Firm provides company management and Human Resources with updated and timely legal advice and counseling when a claim of sexual harassment is made against the company.  When a request for information is made to a company by the EEOC or a Human Rights Commission, Mr. Dolley drafts position statements providing detailed information as to why an employer is not liable for sexual harassment under the legal standards set out in Title VI or in state law.

Defense of Sexual Harassment Claims

When an employer is sued for sexual harassment, the Firm's specialized knowledge of discrimination law and sexual harassment litigation provides for effective defense against such claims.   Attorney Kevin J. Dolley aggressively asserts an employer's position as to why the employer is not liable for sexual harassment and establishes the affirmative defenses of the employer by showing that prompt remedial action was taken by the company and that the company had policies and procedures against harassment in the workplace at the time the claim of harassment was made by the employee.   The Firm works with companies to prove that the employer took reasonable step to prevent the conduct and that ownership or management promptly corrected any inappropriate behavior that came to its attention.  Further, the Firm points out to the EEOC, state Human Rights Commission or Judge how the employee may have unreasonably failed to take advantage of the company's corrective measures, policies and procedures.

The Firm actively litigates claims on behalf of management by defeating the employee's attempt to establish all the required elements of a harassment claim.   The Firm represents clients sued for sexual harassment under Title VII and the Missouri Human Rights Act and before the Missouri Commission on Human Rights, EEOC, state and federal courts.

Preventative Counseling for Employers

Beyond defending employer's in sexual harassment litigation, the Firm provides comprehensive legal counseling to employers to avoid future sexual harassment claims through development of legally appropriate policies and procedures for the company.
