Sarbanes-Oxley Act Whistleblower Protections

The Sarbanes-Oxley Act of 2002 was passed in response to major corporate scandals and to provide protections to individuals that reported knowledge of corporate misconduct.   Employees are protected under the act from retaliation for reporting corporate fraud and illegal activity.  Such reportable misconduct includes securities, mail, band and wire fraud and fraud against shareholders or other SEC violation.  The umbrella for Sarbanes-Oxley protection extends to corporate officers, employees, agents, contractors and subcontractors.

Establishing a Sarbanes Oxley whistleblower case requires evidence that the employee provided internal company whistleblowing relating to company fraud or misconduct or for an employee who participates in a federal investigation by providing testimony or reporting for a federal agency, including the SEC.
