Potential Discipline by the Missouri Real Estate Commission

Pursuant to Missouri law, the Missouri Real Estate Commission is allowed to take certain actions against a Real Estate Professional's license if certain statutes, rules, or regulations are violated. The general levels of discipline that can be used are revocation, suspension, probation, and censure of a real estate license. Missouri Revised Statutes Chapter 339 sets several actions that subject a real estate license to discipline, including the following:

  • Failure to keep deposit in a special account
  • Making substantial misrepresentations or false promises
  • Suppression or concealment of material facts
  • Failure to remit money that belongs to others
  • Using prizes, money, or gifts as inducement to secure customers when it the prize, money, or gift is contingent on the purchase
  • Failure to inform seller of all written offers without waiver from seller.
  • Use of a controlled substance
  • Engaging in or committing mortgage fraud

Complaints to the Missouri Real Estate Commission

When a complaint is made against a real estate licensee to the Missouri Real Estate Commission, a copy of the complaint is sent to the licensee. Once the licensee receives the complaint, he or she has thirty days to respond in writing. It is important to seek timely legal counsel if you are notified of an investigation.  Attorney Kevin J. Once the Commission receives the case file, they will review it at their bi-monthly meeting to determine if further investigation is necessary. However, if further investigation is ordered the investigator will contact the parties and eventually submit a formal report.
