Legal Counsel for Pharmacists in Disciplinary Proceedings Before the Missouri Board of Pharmacy

The Law Offices of Kevin J. Dolley provides legal counsel for Pharmacists notified that they are under investigation for discipline by the Missouri Board of Pharmacy. Attorney Kevin J. Dolley is experienced in defending individuals before administrative boards and provides effective representation to protect your license.

Potential Discipline for Violating the Pharmacy Practices Act

Pursuant to Missouri law, the Missouri Board of Pharmacy is allowed to take certain actions against a Pharmacist's license if the Pharmacist violates the Pharmacy Practices Act. This potential discipline includes revocation, suspension, probation, and censure of a license. Missouri Revised Statutes Chapter 338 sets several actions that subject a pharmacy license to discipline, including the following:

  • Illegal use of a controlled substance
  • Fraud, deception, misrepresentation
  • Incompetence or gross negligence in performing job duties
  • Failure to display a valid certificate or license when required
  • Violation of professional trust or confidence to the public
  • Violation of any drug laws, rules, or regulations
  • Intentional misappropriation of prescription drugs

Complaints to the Missouri Board of Pharmacy

When a complaint against a Pharmacist is received by the Missouri Board of Pharmacy, it is reviewed by the Executive Director. If the Director determines that it has jurisdiction and that there is sufficient information, the complaint will be sent to a Board investigator who will inquire into the allegations. It is important to seek timely legal counsel if you are notified of an investigation. Attorney Kevin J. Dolley effectively helps clients respond to investigatory complaints. After the investigation is completed, the Board investigator will forward the file to the Board of Pharmacy to review at the next meeting. If it is determined that there is not enough evidence or that there was not a violation of Pharmacy Practices Act, the charges will be dismissed.

If Board believes that a violation of the Pharmacy Practices Act exists, they take one of two different actions. First, they may request the Pharmacist to give a written statement before closing the file. Second, they can give the case to legal counsel whereby formal charges are entered against the licensee with the Administrative Hearing Council or immediate discipline is sought against the licensee. Before the AHC, the parties have the ability to present evidence in a trial-type format. Attorney Kevin J. Dolley represents clients in administrative hearings and has successfully dismissed or limited disciplinary action against licensees.

It is crucial to have experienced counsel on your side to protect your interests and avoid unnecessary discipline of your license. Attorney Kevin J. Dolley will assist you in preparing a strong response and defense that applies the facts of your case to the Pharmacy Practices Act.
