Legal Defense for Dental Hygienists and Dental Assistants

The Missouri Dental Board certifies and regulates dental hygienists and dental assistants. Under Missouri law, a dental hygienist is someone who performs certain procedures under the supervision of a licensed dentist. These include removing deposits from teeth, polishing teeth, and performing clinical examinations of teeth and tissues for diagnosis by a dentist. Practice as a dental hygienist without a certificate issued by the Board is prohibited by statute.

A dental assistant is someone who provides patient services in cooperation with and under the supervision of a licensed dentist. Certain procedures performed by a dental assistant may qualify as the practice of dentistry under Missouri law.

Any person who practices without an appropriate certificate may face administrative or criminal penalties or a civil injunction. The Board may file a complaint against a dental hygienist or dental assistant with the Administrative Hearing Commission (“AHC”) if the Board believes he or she is not practicing in accordance with Missouri law. In that event, the hygienist or assistant has the right to a trial-type evidentiary hearing in which he or she has the right to examine evidence, the right to cross examine witnesses, and the right to call witnesses and present evidence. If cause for discipline is found to exist, he or she faces a second hearing before the Board to determine what, if any, discipline is appropriate. Potential discipline includes probation, suspension, or revocation.
