Wage Garnishment Laws in Missouri

Wage garnishment is a legal procedure which happens when a creditor withholds a percentage of your income to pay a debt that you have failed to pay on your own. Sometimes you can opt for a voluntary wage garnishment if you keep forgetting to pay a specific bill and want to make sure that his happens on a regular basis. Other times, the creditor will get court-ordered wage garnishment permission, so that they can take money from your paycheck regardless of whether or not you would prefer this action.

In the state of Missouri, a creditor is allowed to take less than 25% out of each paycheck as is appropriate to cover debts. Most of the time, if a debtor is the head of a family then the creditor is only allowed to take 10% or less of the wages. Also, the law permits that an individual can take the amount that is 30 times the federal minimum hourly wage if this works better with the payment structure.

One of the most common types of wage garnishment is for child support. When it comes to these payments, they can be as high as 50% of each paycheck depending on how much is owed. Child support garnishments normally take propriety over any other garnishments that are allowed unless the IRS has a preexisting wage levy against the employer. The federal law prohibits all employers from terminating employees based on wage garnishments no matter what the reason for the garnishment is.
