Former Missouri State Employee Files Age Discrimination Lawsuit

Earlier this year, a former employee filed a lawsuit against the Missouri Highways and Transportation Commissions. She is seeking damages for alleged age discrimination. She had worked for the Missouri Department of Transportation since 1997. During her tenure as a public affairs manager and then a community relations manager, she never received a reprimand, and she was a highly regarded employee with a history of positive remarks, according to court papers.

Recently, the Highway Commission and the Transportation Department felt a financial squeeze and decided to lay off workers. According to the lawsuit, there was a "Five-Year Direction" plan that listed employees according to their age and tenure, a retirement eligibility list off of which layoffs would be based. When the former employee was informed that she would not be kept on, she filed an age discrimination lawsuit three days later. She was demoted. According to the lawsuit, she was also made to move into a storage room that had mold and lacked adequate heating. She ended up working from home.

If the court deems that age discrimination was indeed a "contributing factor" in her layoff, this would mean a violation of the federal Age Discrimination and Employment Act. Some level of compensation would be owed to the wronged employee. There are many such laws in place to help prevent against workplace discrimination. This means it is illegal to refuse to hire someone based on their race, to suspend someone for their gender, or demote a worker because of their ethnicity.
