Cable Installers Overtime Rights Attorneys

The Law Offices of Kevin J. Dolley, with offices in St. Louis and Kansas City, Missouri, is highly skilled in representing cable installers in unpaid overtime claims across the country. Cable installers commonly work all over the country and often work in difficult and hazardous conditions. Cable installers, however, are also commonly treated poorly in how they are paid.

Cable Installer Overtime Rights

Companies, including cable subcontractors and telecommunications companies violate the overtime rights of cable, phone and internet installers under the Fair Labor Standards Act (FLSA) by misclassifying them as independent contractors, paying piece rate wages or a salary without overtime pay for hours worked in excess of 40 hours per workweek.

Unfair Wage Practices Against Cable Installers

Paying wages on a piece rate basis is permissible but cable installers and other non-exempt employees still must be paid overtime pay at time and a half for all hours worked in excess of 40 hours per week. Cable installers are commonly misclassified as independent contractors and thereby denied overtime pay and other benefits commonly provided to employees. Cable installers are permitted to receive a salary but still must be paid overtime compensation. Employees are permitted to provide their best faith estimates of hours worked per workweek in determining the appropriate amount of unpaid overtime backpay and lost wages.

Cable Installers Misclassified as Independent Contractors

Cable installers are commonly misclassified as independent contractors. Cable installers who are misclassified as independent contractors are commonly required to fill out an employment application, complete mandatory training, work set schedules, attend appointments and meetings, wear the employer's logo on shirts and vehicles, request leave for time off, are subject to termination, purchase tools from employer, and account for the company's supplies and equipment.
