The Law Offices of Kevin J. Dolley's Victory Before the Missouri Supreme Court
A Seminal Change in Missouri Employment Law

In 2007, the Law Offices of Kevin J. Dolley argued for and established before the Missouri Supreme Court a changed employment discrimination standard under the Missouri Human Rights Act at the summary judgment stage in Daugherty vs. City of Maryland Heights.  This standard for discrimination claims is unique to Missouri and Mr. Dolley has been the leader and innovator in Missouri labor and employment law in the most recent years.

Discrimination Laws Applicable to Missouri

Claims of employment discrimination are based upon a number of state, federal and possibly local laws.  The State of Missouri has adopted the Missouri Human Rights Act which provides that it is discriminatory to not hire, fire or otherwise discriminate against an employee because of such individual's race, color, religion, national origin, sex, ancestry, age or disability or retaliate against an employee for asserting particular legal rights.  Federal law addresses employment discrimination and wrongful termination through such Acts as Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and the Family Medical Leave Act (FMLA).  Some of these laws require that the employer have a certain total number of employees and there are different statutes of limitations in which a claim must be filed for a claim to be actionable.

Litigation of Employment Disputes

Allegations of discrimination based upon race, color, national origin, gender, age, religion, as well as issues of retaliation are highly volatile, and are the subject of a tremendous amount of litigation.  The Law Offices of Kevin J. Dolley provides guidance to employers, management and employees on the applicable state and federal laws that govern employee hiring, compensation, treatment and termination.

In Mr. Dolley's role as counselor, he provides practical, proactive solutions that will help avoid disputes and unnecessary litigation.  The Law Offices of Kevin J. When these claims cannot be resolved quickly, the Firm is prepared to represent clients before administrative agencies and in court.  Attorney Kevin J. Alternative Dispute Resolution

In all cases, the Law Offices of Kevin J. Dolley provides practical advice, negotiating skills and litigation expertise for its clients.
