Mediation of Employment Disputes
Many labor and employment law disputes, including employment discrimination claims, are resolved through mediation. Mediation often provides a cost-effective method of resolving employment disputes. Mediation is a form of alternative dispute resolution in which a neutral mediator facilitates discussions between parties and their lawyers with the goal of reaching a mutually satisfactory agreement.
The Mediation Process
The parties to the dispute are in control of the mediation process and the parties are not compelled or forced to reach an agreement. Mediation allows the parties to craft agreements that allow for agreement on matters that a judge or jury could not address. These matters may include positive job references, personnel file issues and structured settlements.
Agreeing to Mediation
In employment law disputes, mediation typically occurs through the EEOC or Missouri Commission on Human Rights mediation process, through court-ordered mediation or through voluntary mediation agreed upon between the parties.
