Dolley is highly familiar with the Federal rules governing class actions, including Rule 23 of the Federal Rules of Civil Procedure, and 28 U.S.C.A. ยง 1332.  He also understands the process of removing class action suits filed in state court to federal court, a move thought to be quite beneficial to Defendants.  Under the recently enacted Class Action Fairness Act, federal courts now have original jurisdiction for class actions where the amount in controversy exceeds $5 million and at least one plaintiff is a citizen of a state different from that of the defendant.  This Act eased the requirements for filing in federal court, thus reducing Plaintiff forum-shopping for class action friendly courts.  Attorney Kevin Dolley also possesses extensive knowledge of Missouri Rules of Civil Procedure governing class action suits under Rule 52.08.
