Why Field Service Technicians Are Undeniably Entitled to Overtime Compensation
The Department of Labor (DOL) and federal courts have long held that service technicians are entitled to overtime compensation for hours worked in excess of 40 hours per workweek as non-exempt employees. The DOL previously examined a case involving field service technicians who worked across the country servicing conveyor belts. It was noted that the technicians make use of independent judgment, problem solving and repair skills as part of the job.
The Fair Labor Standards Act (FLSA) provides overtime pay to all employees except those who are exempt from the overtime requirements. The DOL noted that field service do not qualify for any exemption.
The DOL noted its long-standing determination that service employees and repair technicians, including field service technicians are entitled to overtime pay. Overtime must be paid to employees whose work includes installation, diagnosis, and repair of equipment. Field service technicians are commonly highly skilled employees but such knowledge and skill does not exempt such employees from the FLSA's overtime requirements.
